By accessing or using WeatherAhead ("the App," "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms constitute a legally binding agreement between you and WeatherAhead ("we," "us," or "our").
WeatherAhead is a community-based weather and road-hazard information platform designed to assist commercial truck drivers. The Service aggregates third-party weather data, user-submitted hazard reports, and publicly available regulatory information for informational purposes only.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. We expressly disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Weather data is sourced from OpenWeatherMap and other third-party providers. We make no representations regarding the accuracy, reliability, or timeliness of such data. Road and weather conditions change rapidly and without notice. Always rely on your own direct observation of conditions and your professional judgment.
The risk levels (Low / Medium / High) and FMCSA-based safety tips displayed in the App are general estimates based on publicly available data and simplified models. They are not certified safety assessments, not endorsed by FMCSA or any government agency, and not a substitute for professional driver training or judgment.
Risk scores do not account for all variables affecting road safety, including but not limited to: vehicle mechanical condition, driver fatigue, local road geometry, real-time traffic, or micro-weather variations. Actual conditions may differ significantly from displayed estimates.
WeatherAhead allows users to submit hazard reports, descriptions, and photographs ("User Content"). Pursuant to Section 230 of the Communications Decency Act (47 U.S.C. § 230), WeatherAhead is not the publisher or speaker of User Content submitted by third parties and is not liable for such content.
User Content is submitted voluntarily by community members and is not verified, endorsed, or guaranteed by WeatherAhead. Reports may be inaccurate, outdated, or fabricated. Do not rely solely on community hazard reports when making driving decisions.
By submitting User Content, you represent that: (a) you have the right to submit it; (b) it is accurate to the best of your knowledge; (c) it does not violate any law or third-party rights; and (d) you grant WeatherAhead a non-exclusive, royalty-free license to display and distribute it within the Service.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEATHERAHEAD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of life, personal injury, property damage, loss of profits, or loss of data, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
In no event shall our total liability to you exceed the amount you paid us in the twelve (12) months preceding the claim, or $10.00 USD, whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless WeatherAhead and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) User Content you submit; or (d) your violation of any applicable law or regulation.
References to FMCSA regulations (49 CFR Parts 390–399), NHTSA research, and other federal guidelines within the App are provided as general safety information for educational purposes only. They are not legal advice and do not constitute an official interpretation of any regulation. Consult a qualified attorney or your carrier's compliance department for legal guidance.
The Service uses weather data from OpenWeatherMap (openweathermap.org), map tiles from Mapbox, and other third-party providers. We are not responsible for the accuracy, availability, or content of third-party data. Use of third-party data is subject to their respective terms of service.
We reserve the right to modify or discontinue the Service at any time without notice. We may update these Terms periodically. Continued use of the Service after changes constitutes acceptance of the revised Terms. The effective date at the top of this page reflects the most recent revision.
These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
